Legal Question in Civil Litigation in California

Sued over verbal contract

I was responsible for providing one dj

and two dancers at a sweet 16. The

dancers were on time however, the

dj was 1 hour late. Because the Dj

was late the client is suing me for

10,000(all party expensies). There

was no

written contract. Can he do that? He

is the owner of a law firm.

Re: Sued over verbal contract

Can he? Well, he did, didn't he?

Anybody can sue anybody for anything. Winning is different.

First, have an attorney contact him to try to resolve this. You talking to him is wasted breath. If you are forced to defend, file answers and motions, etc., you'll spend substantial attorney fees. Without a written contract, no one gets any attorney fees awarded by court, you each eat your own.

Feel free to contact me if serious about getting legal help, if this is in SoCal courts.

Re: Sued over verbal contract

He can sue you. Although I doubt he will win. He still had a party. He can refuse to pay your fee as you breached your contract.

Re: Sued over verbal contract

If he received the benefit of the contract for the most part, then he won't recover damages. But the other advice is correct. Yes, he can sue you, but it doesn't mean he'll win.
