Legal Question in Sexual Harassment in Colorado

Hostile Work Environment at a Call center

I have worked in a call center for 90 days. During my 5 weeks of training (evenings) a group of smokers who became drinking buddies over the course of the class became obnoxious to the point of disrupting the class. (I have proof of drinking in the company parking lot.) I told the instructor that the class could use a reminder about sexual harassment laws. He told one of the Supervisors about my complaint, and the Supervisor asked one of the guys what was going on in class. The guy immediately came up to me in anger and asked ''Who complained about sexual harassment in our class...I think it was...'' and he used my name. I admitted it was me, and said that the class needs to be reminded that this is still a work environment.

Now, I listen to very loud sexual comments all day long. We are required to ''smile while we are talking to the customer'' so that the customer can ''hear us smiling'' in the tone of our voice. I wear a headset in my right ear, and an ear plug in my left ear. A young female Hispanic Supervisor is now pregnant from one of the 19ish guys from the group. I have complained about the noise level to the manager, and the sexual talk. The pregnant Supervisor laughs about it. I also have social anxiety & cringe. Legal suit?

You can't file a lawsuit until you have taken some preliminary steps. I suggest you complain in writing to your employer's human resources department about the harassment. You can also file a charge with either the Equal Employment Opportunity Commission or the Colorado Civil Rights Division. Filing a charge with either agency is a requirement before a lawsuit would be possible. There are time limits on when you must file a charge or lose your legal rights.
