Legal Question in Personal Injury in Illinois

Personal Injury - rear end automobile accident

My daughter was hit from behind by another student waiting to pull out of school. She was taken by ambulance due to neck and back injury which was not severe. Insurance company is offering $100 over the medical bills to settle. How do we know what amount is fair. This amount does not seem right to me. I'm not looking to get rich but my daughter's pain should be worth something. Thank you for your help

I think you are most likely getting shorted on the deal.

I cannot tell you the "correct" amount to ask for but $100 over the bills is not acceptable - unless your daughter went to the hospital solely to get "checked-out" and NOT due to any pain or injury.

How much are the bills and from whom?

How much property damage to her car?

Let me know and I'll try to give you some pointers.

No doubt about it, the insurance company is being unfair. I cna nto tell you how much, however, if she had any followup, had to avoid certain activities for a while and had pain killing medication, $100 is off base.

I could provide you more information if you can tell me more details about the injury, the actual impact,any property damage, medical care and your daughter's age.

The adjusters from the insurance companies get paid a bonus based on the amount they can save the company--that is how far they can short change the injured party.

$100 over medical bills sounds like a slap in the face to me--and I don't care how much medical bills have been incurred.

You have two choices:

1- roll over and play dead and accept what the insurance company offers you.

2- fight it--that is get an attorney and have the attorney fight for you because you stand no chance of winning first against a trained adjuster and then against seasoned attorneys defending the insurance company.

On the average, it has been proven that those retaining an attorney end up with more compensation in their pocket than those who fail to do so. That is a proven fact--and that is why the adjusters are all over the case from the get go trying to settle the case as soon as possible (even going so far as telling you that you won't get any better deal even if you were to file suit) because they know if you wise up and get an attorney, they will end up having to pay more.

You don't have to hire my firm but whatever you do, the best advice I can give you is to have your case reviewed by an attorney and see what can be done.
