Legal Question in Family Law in Michigan

How can we get supervised visits because children are being molested?

We have custody of my husbands 2 girls. They have been molested several x's over the last 2 years by their 14 yr. old uncle. We have a court order that they aren't to be around him but their mother continues to take them around him anyway. The judge ordered an eval we paid for and it came back we were telling the truth and the girls had been messed with. Instead of going back in front of the judge it went in front of the referee and he never looked at it. He is letting her take them every other week this summer and they are getting molested again. just last week. We have videotape and a journal we have kept over the last 2 years. We have pic's from the hospital of they younger girl being bruised between her legs on 2 sep. times and once red, raw and bleeding. This isn't enough for anyone. Protective Services won't do anything because it isn't the caregiver abusing them. We have them in counsiling again but this doesn't protect them now. They are both wetting their pants and telling us he--name removed--them again. What can we do? Can anyone help?

It certainly sounds like the matter should be taken before the judge on an emergency motion. The referee's decision is not binding if a review is sought before the judge. I suggest you request a hearing before the judge asap. For more info, please contact my office at (248)851-3171.
