what are the penalties for credit card fraud?

First I need to know if were are talking state or federal and then the specific statute number or the amount of money. Even then, there may be other crimes out there that are related.

On the State level, credit card fraud can be 2nd degree, so that is 5 to 10 years. Depending on the other charges, you could get more time. If you also have Federal charges, then you could get even more time.

Credit card fraud is a variety of theft and as such the degree of offense is defined by amount

of money or value involved. $200.00 or under is a disorderly persons offense with a maximum jail sentence of six months. More than $200.00 but less than $500.00 has a maximimum sentence of

18 months in jail. $500.00 or more, but less

than $75,000.00 has a maximum jail sentence of

five years and $75,000.00 has a maximum jail

sentence of ten years with a presumption of custodial as opposed to noncustodial sentence.
