Legal Question in Civil Litigation in New Jersey

My boyfriend and I purchased a property together three 1/2 years ago. Two weeks ago he informed me that he did not want to be toghether anymore. Since I am devestated I can not bring myself to stay there, on the other hand he wants to stay. I am currently living with my daughter and her husband.

I am paying them so i can stay. Do I have to pay half of the mortgage if I am not staying at the home he and I purchased ?

If you don't pay and he doesn't make up the difference, the lender may foreclose.

If your bf won't buy you out, you can force a sale by suing for "partition." That will result in the sale of the property and a division of the proceeds.

The lender looks to both of your to pay the mortgage; legally, you are bound to pay the mortgage. If your relationship is over you should take legal action to either sell the house or compell him to buy you out. Your credit is at stake.

You are risk if your bf does not pay - and your own equity is locked up! Consult with counsel to reach an agreement or bring suit to be repaid your $ and to compel a refinance.
