Legal Question in Civil Litigation in New Jersey

Divorce and I'm disabilty, what are my rights

I'm in the early stage of a possible divorce. I've been married 10 years and have two children ages 7 and 5. A little over a year ago I had an accident and broke my neck. I'm paralyzed but have partial movement. What are my rights as a father even know I'm paralyzed. Also is there a booklet or website that iI can find this infomation.

The fact that you are suffering from a disability does not impose any particular limitations on your parenting time rights or responsibilities.

The question would be: does your disability affect your parenting? There are plenty of people with physical hadicaps that have parenting time and even sole or primary custody.

You have not suggested any reason to label you as unfit or incapable of parenting and that would be the basis for any limitations on parenting time. Do not let the label of your injury restrict you. Ask yourself: is there anything you cannot do in taking care of your children?

Your lawyer will explain that if and when you get that far.
