Legal Question in Employment Law in New Jersey

Employer Retaliation / Hostile?

In June of 06 my boss (VP Marketing) had a meltdown and started to verbally abuse our vendor at a trade show. I happened to be near him at the time and overheard everything. He was later turned into HR for this. I was called into HR and asked a series of questions - all of which I answered honestly. A few weeks later the company decided that I could no longer work directly for the VP, as it would be a conflict of interest. Subesquently - I was told that I would no longer be working in New Business Development - and would be taking a role as a product Director - reporting into another director.

I relocated to this company specifically for the experience of reporting into the VP, and on the New Business Dec. team.

It may be noteworthy that he has a record of verbal, physical abuse, sexual harrassment, hostile environment, and a HR file that is 2 feet thick.

So the basic series of events:

1) Boss has melt down.

2) I get reassigned - still paid the same - title and responsibilities changed - though still a director.

3) He remains - with nary a slap on the wrist - again.

4) Every reason for coming to this company is gone

Re: Employer Retaliation / Hostile?

You have too many questions, and your situation is far too sensitive, for you to get meaningful advice from a website.

The question you did not ask, but probably meant too, was, what are my legal rights. Ordinarily the answer would be no, but at the level you were working, it is possible. The answer depends upon whether you have an employment contract, and if so what the terms are, what it is that you said about the VP in your interview, and whether you were the victim of any of the incidents generating two feet of file.

Employment law is a specialty. You will need to find an attorney experienced in that field. You will most likely have to pay for an intital consultation. In fact I would not bother speaking to an attorney who did not charge a fee.
