Legal Question in Employment Law in New Jersey

Can I be terminated

I recently return to work from a maternity leave, my dept. has been required to have someone in the office from 7:30am-6pm..total of 4 employees in this dept. I was just told that our dept. is going to be required to have the office covered from; they would like from 7am-7pm, but 2 employees cannot do the 7am shift, myself and a single mom, so we were told we would stay w/ the 7:30-7pm for now, on a rotating schedule. I'm wondering if they can make a change in our schedule like that. It will be a hardship to cover to 7pm, and I do not want to agree to anything if I don't have to. I also asked my supervisor what would happen if I could not cover till 7pm, and was told she never asked our director, and was told to just work it out. I don't thing in my job description it has anything about hrs., but if it does can I hold then to the 6pm if it is stated in there. We were also given a few weeks to make arrangements to cover til 7pm. I do not want to agree to it, and find out at a later date that I can not cover til 7pm, and be told that I agreed to it so now I have to work it.

Re: Can I be terminated

If this is a union job , the terms of your contract will cover. If it is not, the employer may adjust schedule accordingly, depending on the nature of the job and the employer.

Notwithstanding the above you can still make a strong case for hardship that will allow an accomodation of your problem. The nature of your hardship will determine how strong a case you can make
