getting a title for a car purchased

I paid a guy for a car back in Dec of 06 and he hasn't been able to give me a title for it yet. I paid him 3000 for the car cash money. He was to pay the loan company off that was holding the title for collatoral. He has told me several stories about the title being sent and then lost in the mail etc. What can I do to get the title? I want to keep the car.

If the title was really lost, the guy would be able to go to the title bureau and get a duplicate in a couple of hours. Ask him to get a duplicate or ask him to sign a power of attorney that will allow you to get the duplicate! If he refuses, I would be worried that he does not have a title, either because the vehicle is stolen or, more likely, the finance company has not been paid and they have the title! If that is true, they will not release it until they have been paid.

It sounds like you may need to talk directly to an attorney. You can take the guy to small claims but that would not get you the title. Small Claims Court could grant a judgment against the guy but they cannot do anything about the title.

You might try getting a replacement title from the DMV. They do issue them when a title is lost or stolen. You need to call them and get the details.
