Sercuity Deposit

My live in boyfriend and I rented a apartment. WE both signed the lease. My boyfriend pasted away about 8 months ago. Now, I'm moving out of the apartment and my lanlord is telling me that he will have to split the security deposit between myself and my deceased boyfriend's estate or family. Now My boyfriends name shoul have been taking off the lease. What I wanted to know if can he do this?

I am touched by a landlord who is so concerned about such legal technicalities, that said does he know that an estate has been opened? Who the executor is? Or is he planning on holding the money until the estate requests it?

If he tries to hang on to it past 30 days you have the right to sue him for it as well as the costs to file the case with the DJ. Sounds like he's trying to get away without giving the security deposit back. I assume he knew your boy friend died 8 months ago.
