Towing from Apartment Complex

A friend was out of the country. His car registration and inspection went out of date while he was gone. This was the only reason his car was towed.

The Condo Association took the liberty of placing a notice on his windshield but did not make contact with him.

I would like to bring action in small claims regarding the lack of proper notification.

Per the new Texas Trans Code 684.0125 HB560...it is my impression that landlords must do two things:

1. Notify IN PERSON

2. Certified letter w/in 10 days.

In this case, they did neither. Perhaps they are unawre of the new 2004 revision to the code that requires the above two actions.

My question: I would like confirmation that he indeed does have a valid case that he can win.
