Legal Question in Criminal Law in Virginia

legal search?

Ihad a knock on my door this morning & when I answered it was a cop saying that from a helicopter they had seen suspected marijuana growing there and if they could look. so i walked with them to the garden& there were no plants. In the meen time two other police had already been searching the yard & found two small marijuana plants more than 300 ft. from where they said they saw them. they confiscated the plants & said they had the right to search my house & found a small amount of marijuana & a pipe. they took pictures of everything didnt charge me with any thing and said they would be in touch later. my question is. Is it a legal search, and do I need a lawyer?

Re: legal search?

If you consented to the search it is legal. Issues dealing with search and seizure can be complex and it is always wise to consult an attorney. I would suggest you contact an attorney if you are charged.

Re: legal search?

It's a legal search, because you consented to it. Don't do that!! Yes, it would be a good idea to get a lawyer. Google for "busted site:youtube.com" for an excellent video about why you should never consent to a search.
