If the man or his heirs can show this exceeded necessary force, then they can make a claim. Such cases are tough to prove, but contact me if you want to discuss the facts and issues.

The victim, or the victim's family if the victim died, would have to sue. The type of lawsuit depends on whether the correctional officer was acting within the scope of his or her employment. Time deadlines are very short in such cases and the appropriate person needs to call a lawyer without delay. Only retain a lawyer with specific experience in police misconduct (42 USC 1983) cases.
