Legal Question in Civil Rights Law in California
website concerns
About a year ago, I sent my ex boyfriend photos of me, and some were nude. Very private. I later find out he puts me on a free website, and put other personal information about me including my aim screen name so people from the site could harrass me. I paid the website to take the photos down, the person that owned the site agreed to, then later lied. My ex boyfriend is apart of the website too. He is a site contributer and he can make say so's about leaving my photos up. Can I sue? And now he is making personal threats towards my family because individuals found out he did this and are sending him messages... Again. Can I sue? and what are my rights as an american citizen.

Re: website concerns
Your rights were to not have 'published' the pictures by sending them to him, which he freely re-published. Now, yes, you may have a case to sue him for 'emotional distress' and 'privacy' violations', but weigh careful the costs of litigation in doing so, versus the likelihood of ever recovering anything. Even if you win, is he a rock from which you can get blood, to use an old cliche? Plus, the more you stir the pot, the wider he may distribute them before you can stop him, if even you can. If truly serious about pursuing this, feel free to contact me for the legal help you'll need.

There is no 'taking them down' once spread, because the court only has jurisdiction over him if you sue, not over numerous web sites around the world.
