Legal Question in Technology Law in California
I have posted my own picture (my portrait) on my website with a "copyright" statement for all my articles and photos on the home page. Lately, someone copied it and posted on his own blog and many different discussion forums as a way to attract viewers when he insult me. However, he claims "fair us." Can this be "fair use?" Please tell me how can I ask him to remove my picture from all these places? Thanks.

Using someone else's picture without permission is much less likely to be a copyright violation than it is to be a species of invasion of privacy. I'd suggest you take the basic facts to lawyers in your community that seem to specialize in invasion of privacy type torts.
