How can I beat having to pay alimony to my spouse who are well capable of earning her own income?

There is case law on this. There aren't enough facts given on which to base an answer to this question. The court looks at many factors to determine spousal support. Some of those factors are age, ability, length of marriage, etc. You should consult with an attorney. A good attorney will be able to look at all the factors and determine the position you should take when going to court.

The issues are too complex to give you an answer that has any credibility. I suggest that you talk to an
attorney so that he can obtain all of the relevant facts. Generally, spousal support is based upon the payor�s ability to pay support and the need of the payee for support. The ability and need are based upon the actual earnings of the parties at the time of the order or the ability of the parties to
earn. One option for you is to obtain a vocational evaluation which will establish her ability to earn. There are many more options and you should retain an attorney to assist you. Good Luck, Pat McCrary
