Hi Rose. There are many options out there from self help divorce paperwork centers staffed by paralegals and attorneys who process uncontested divorces. The rates will vary but typically you get what you pay for. The paralegals can not give you legal advice and are not attorneys.

You should consult with a local attorney and consult with your brothers ex to determine if they can agree to the terms of the divorce. If they are agreement and can put it in writing then many attorneys can charge a flat rate for the divorce. Typically it would range from 1000-2000 dollars for an uncontested. The filing fee is 395 dollars which goes to the court clerk.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
