Legal Question in Family Law in California

child custody and support

My son is 15 and is coming to live with his father. We have a custody and support order showing that he lives with his mom and the father pays child support. The mother and father both agree to change this so the father is the custodial parent and will ive with him and the mother will then pay support. Can we just fill out an agreement for custody and support and both sign it and file it with the court? What do we have to do to change this around?

I have filed stipulations with the court like this. There might be a $20 fee or something.

You should prepare a stipulation and order for the court. There is some legal language that is required concerning notice and knowledge of rights. Your local facilitator's office may be able to assist you in preparing that stipulation. I charge about $250 for the stipulation. If you prepiously had an attorney, he or she may prepare the stipulation. Good Luck, Pat McCrary
