o.k. guys now I've been surfing the web today and finally come up with a form called AMENDMENT TO COMPLAINT (FICTIOUS/INCORRECT NAME)

Is this what I'm looking for?

It depends. Are you looking to amend your complaint to show the true name of someone you sued under a fictitious name (John Doe)?

In San Francisco, you actually have to file a motion to change a defendant's name, accompanied by an order, and set a hearing date. You might be able to do it on an ex parte, expedited basis, however.

I believe you are the person who has been posting about having lost a demurrer, but have leave to amend. If so, no, that is not the correct form, and if you could not tell that from reading the papers filed in the case already and the court's ruling, you really are in so far over your head there is no chance of you winning the case. Most likely it will just be thrown out on the next demurrer. You really need to stop looking for advice here piece by piece, and get an attorney involved directly, even if just in an advisory capacity. As Mr. Stone often likes to say, if you can't afford an attorney, you must be able to afford to lose the case, because that is what will surely happen.
