breach of lease

I have a lease on an apartment from September 6, 2005 to August 6, 2006. Today is the 2nd of August, 4 days before the lease is up. My landlord is already moving the new tenants into my apartment. Is that legal?

Re: breach of lease

If you gave the landlord notice that you'd be out before then, of course it's legal. If you're still in possession of the unit (i.e. hadn't turned in the keys, have your personal property there), it's a breach of lease. If you've been harmed in some way, then it might be worth pursuing.
