Legal Question in Personal Injury in California
Accident fault and possible suit
According to a witness I ran a red light and collided with a woman speeding in another direction.I do not recall the light. She was injured(neck cuff and taken to hospital but she appeared ok) as she spun out of control and hit a lightpole. I was in a larger car and uninjured. Both cars are probably totaled. I have no previous tickets or accidents. If she should sue me how can I protect my assets. I have auto insurance. But if she sues above the amount of my policy. What do I do with my assets before a suit? Neither of us were sited at the scene. We live in an affluent area and people who like to sue. No law suit yet accident was yesterday. Thanks

Re: Accident fault and possible suit
Turn this matter over to your autombile insurance carrier and they will hire a law firm to handle your defense. Be sure that you speak only to your lawyer about this accident. As always, insurance is your best protection in matters such as these, but it is the insurance that you had at the time of the accident that will be available to you.
Re: Accident fault and possible suit
You are getting a little ahead of yourself. Hopefully, you had more than the minimal limits on your liability coverage. (It should be at least $100,000.00 per person.)Let your claims people handle this. As time goes by, you can check with your company to see the nature and scope of the claim. Your company will provide defense attys if you are sued at no charge and they will try to settle within your policy limits. You can always consult your own personal atty (on your dime) now, but that's not necessary yet. If you have low liability limits, raise them NOW. Same for your uninsured motorist coverage: at least $100,000 per person.
