Legal Question in Personal Injury in California

Molestation

I was molested a couple months ago by 2 men in a resturant then a couple days after it happened I was called by one who told me he'd kill me if he ever saw me again. Is it worth going after these guys??? And afterwards I became emotionally unstable could I sue them for this and how much do you think I could get? It's not about the money though I want these guys put away HELP ME!!!

I am so sorry to hear of your plight.

If you have been a victim of a sexual assault, you should contact the police and prefer charges. They will help protect you through the process. If they have deep pockets, i.e. substantial assets, it is also worth suing them civilly for damages. If not, there is a fund that provides compensation for crime victims you can apply to.

Proof, of course, is your biggest obstacle. Consider what proof you have. They will probably deny your allegations.

Sue them? Sure, as long as it makes economic sense - meaning, if they have money and assets. If they are poor, and have nothing, then that is what you would get.

If they were management or employees of the restaurant, then that may open the way to suing the restaurant, maybe. Your posting is not clear on who they are, and how they had your phone #.

But, typically suing an individual is done for 'principle' more than economics. The decision is, how much money are you going to invest in suing, and how much can you reasonably expect to be able to recover if you win. If there is economic basis for suing, or you are willing to do so on principle, call me to discuss.

Your other option is to report and pursue criminal charges, telling the police about the threats as well. Do so quickly; you have already waited a long time to be taken seriously.
