Legal Question in Civil Litigation in Colorado

My dog was attacked by my new neighbor's dog through a hole in the bottom of a fence separating our yards. My dog sustained very significant injury, including a fractured jaw and punture bite wounds. Repair of the jaw required interdental wiring and 8 weeks of healing before wires can be removed. Vet bills are so far at $2500 and climbing as we have checkups and more xrays as well as the removal of the wires. So far the neighbor has not offered to pay but has asked for the copies of the bills. Is it too late to file a report? Are my neighbors liable for the damages their dog caused and should they pay?

I'm sorry to hear about this. It can't be easy to see your dog suffer like that.

You haven't provided enough information to answer your questions, I'm afraid. Who owned the fence? How was the hole created? How long had it been there? Did you know about it before this happened? Was the other dog on a leash or other restraint? Was yours? Were there steps you or your neighbor reasonably could have taken to prevent this, either before or after the other dog entered your property?
