Is it legal to access someone's email if you are given the password by that person?

If you have authorization to do so, which is implied in your question, then of course you may access the e-mail. If you have not received permission or stole or "figured out" the e-mail password, then you should not access the account.

Also if you were given the password but you know that they no longer want you to use it, then you no longer have the right to use it.
