Legal Question in Medical Leave in Florida

Fmla

My daughter is 7 months pregnant and is experiencing some difficulty with preterm labor which requires caring for her and her 2yo. Her husband is in the Navy enroute to Iraq. I have been told by my HR department that this will not fall under FMLA as she is not a minor child and have been denied FMLA but told I can take a personal leave. How accurate is this determination?

Re: Fmla

I believe they are incorrect. FMLA permits leave for family members who are ill. However, as long as they are going to give you up to 12 weeks personal leave without you losing your job, its essentially the same as FMLA since FMLA is unpaid and just protects your job. If you have problems with the leave they are giving you, feel free to contact my office for further discussion.
