Legal Question in Civil Litigation in Florida

Property Dispute.

I purhcased a tv for someone who has failed to make payments. They've paid 250 dollars for the 900 dollar tv and have had it for 8 months. They refuse to make payments and only will return the tv if I give them back their 250 dollars. Im not sure, but I dont feel that I should be in the hole for an item that they wanted. Is there anything they could do legally if I wrote them a check and then canceled it after retrieving the tv?

Re: Property Dispute.

You don't write checks and then cancel them on purpose. That's a very bad way to go about handling things.

Repo the TV. Recoop your loss by selling the TV for a fair used value. Deduct the price you are able to sell if for from the loan you made to your friend (the purchase price of the TV was a loan). Tell your friend he owes you the difference in values - what you are still out after selling the TV. Take him to small claims court if he refuses to pay.

If your friend wants to know about his 250 bucks, tell him it was rent for 8 months worth of use of a new TV.
