Legal Question in Employment Law in Florida

Copy of noncompete

I have been contacting my boss since last thursday, for a copy of the non-compete agreement I signed. I contacted her verbally, written, I've left voicemails, emails and even sent 4 text messages. She has avoided my call and emails. I have requested her attorneys phone number (since she implied her attorney has the original non compete i signed), I still have yet received any type of response letting me know what is going on, or how long i should wait. When I verbally asked for the copy they terminated me and said that they will have to ask their attorney if they should give a copy to me. What should I do? And are they allowed to deny me a copy of it? Will them refusing to provide me with the copy void my contract? I have kept and documented all emails and text messages as well as calls I've made regarding

Re: Copy of noncompete

It "sounds" like they may have lost it. Don't admit that one exists. I'd send them a letter sayiong that you have requested a copy since you are not sure if one even exists and that they have not ever provided you with an executed copy of any agreement that would restrict your right to work where and as you please. Tell them that if you do not receiive a copy in 10 days that you will assume that there is no noncompete or, if there is one, that they have no objection with any work that you may pursue.

That will get you the document. If it doesn't you can start to work as you please. You mmight get sued and then get the document, but you will have a good record for any judge to consider as to why you started working.
