Legal Question in Landlord & Tenant Law in Florida

rental agreement

My husband and I rented a house from someone with a 6 month lease. After 6 months was a month to month bases (which was not in the lease)We stayed for a total of 9 months. We left owing 1/2 month rent. He filed a civil action against us that we didnt find out about until we tried to buy a house. He was granted over $3,000. How can we fight this? Do we need a lawyer or can we do this on our own? And we live out of town, any way we can do everything in 1 trip?

You would have to hire a lawyer to file a motion to vacate the default and seek a trial on the merits. You probably cannot do it effectively on your own. Trial could be 1 trip and if there are no depositions that would probably be all you need to do locally.
