Legal Question in Credit and Debt Law in Georgia

Property Settlement in a Divorce

In my divorce approximately 6 years ago, my ex-husband was awarded, by the court, the truck from our marital assets. He was to pay all payments until the truck was paid in full at which time I was to sign the title over to him. It was financed in both of our names. The court papers state he was to make all payments and not hold me liable for any debts or responsibility regarding this truck. I received a phone call 2 days ago from a collection agency stating the truck had been repossed, sold at auction, and that I now owe the balance of $11,000.00. They also stated my ex-husband has filed chapter 7 bankruptcy. Am I liable for anything on this truck? The phone call 2 days ago was the first time I heard anything about this truck. Nothing about past due payments, nothing about repossession, nothing about it being sold at auction, nothing period until 2 days ago.

He is required to list you in the bankruptcy (and you get mailed notice), and you may be able to object. That doesn't necessarily solve all your problems, but you need to explore it. There are strict deadlines for you to follow.
