Legal Question in Family Law in Georgia

Acknowledgment of Service for Divorce Petition

I personally served my husband with a complaint for divorce. He refuses to sign the acknowledgment of service document. He is not contesting the divorce. What is my next step?

By handing him the complaint yourself he has not been legally served, absent his signing an acknowledgment of service. You will need to have him served by the sherif in the county where he lives or, if your court has a permanent process server(s) appointed, you may use that person. YOu can also file a motion to have a person appointed as a private process server. Each of those options is increasingly more expensive than the other (sheriff is around $25; permanent process server or private process server charge hourly rates of varying amounts).
