Legal Question in Civil Litigation in Georgia

Subpoenaed Banking Records

If you are involved in a civil action, how many years back can your banking records be subpoenaed? Can records be subpoenaed back as far as 1995 or 1996. I cannot remember what bank I had certificates of deposit that many years ago. I have asked at a couple of banks and have received different answers.

That is a question for your lawyer, who knows what the case is about and why the records may or may not be relevant and subject for discovery.

If you have an attorney, you should discuss the matter with your attorney and ask him or her to explain the discoverability of these documents. If you are handling the matter on your own, you need to go to the local law library or get on line to do legal research on discovery in a civil matter. The scope of discovery depends on the case.
