Legal Question in Family Law in Illinois

Mortage Dissolution

How do I go about getting my name removed from the mortgage on a home I do not reside in. The home went to my ex-husband in the divorce proceedings, but my name is still on the mortgage and creates problems in my geting my own credit. He does pay the payments on time, but shouldn't my name have been removed from the mortgage after the divorce?

Re: Mortage Dissolution

The court has no jurisdiction to remove your name from the promissory note for the loan. That can be done only with the consent of the lender or by your ex-husband refinancing the property.

How did you receive your share of the equity in the house?
