auto accident injury

There were 5 kids injured in an auto accident, can they file a class action suit against the driver? He did not have a valid license and was at fault for the accident, however he is a ward of the state fo IL.

Unfortunately no. They will have to file separate suits. However, once they do so, they may be bale to consolidate the cases into one for discovery purposes and possibly trial.

A class action is inappropriate for this situation because there aren't enough plaintiffs involved. They should each get attorneys and file against the driver.
