Legal Question in Personal Injury in Illinois
auto accident injury
There were 5 kids injured in an auto accident, can they file a class action suit against the driver? He did not have a valid license and was at fault for the accident, however he is a ward of the state fo IL.

Unfortunately no. They will have to file separate suits. However, once they do so, they may be bale to consolidate the cases into one for discovery purposes and possibly trial.
Re: auto accident injury
A class action is inappropriate for this situation because there aren't enough plaintiffs involved. They should each get attorneys and file against the driver.
Re: auto accident injury
Dear Sirs:
You may have a case. Under Illinois law, foster parents are no longer sovereignly immune from suit. In fact, our law firm was the firm in Illinois which established this law.
You may therefore have a case which you will be able to file on behalf of the injured children.
Please do not hesitate to call should you have any further questions,
Sincerely,
