Legal Question in Employment Law in India
employer not paying the salary
i have no agreements with him ,
further he has not issued me any
appointment letter, and also there
were no verbal agreements in this
regard, i worked there for 8 months
, and before leaving gave him 1
week verbal notice and 2 days
return resignation letter, which he
didn't confirmed.
after that i left the firm on 31ST july
08, giving him the reason and after
handling the responsibility to my
sub-ordinates
i m struggling for my salary since
then, he makes excuses everytime
when i talk, and now he is not in
terms of talking, i need legal advice
on this matter, please help me as it
is quite annoying for me to handle
the situation

You may send him a written request demanding your dues and may follow up your demand by a legal notice. You may finally require to file a civil suit for recovery which will be expensive and time consuming. you may also be able to lodge your claim through the authorities under the Payment of Wages Act.

If your employer is not paying u wages, then remeady for you is to file suit. However, it is required to known as to what is your designation at work, cause thereupon your forum of redressal will depend.
