Legal Question in Legal Ethics in India
Hi,
If a software employee has an FIR(498A) against him recently then what will happen to his current carrer in the organisation? Should it be good to notify this matter to the company or shouldnt we?
Will the organization treat it as a personal issue or can they take any action?
He is working in the same company from 5yrs and the FIR is filed recently.
What action the organization should take?
Regards,
Latha.

it is for the company to decide whether it is a personal issue or involves moral turpitude. legally speaking, the company is not bound to take an action against the employee who is facing 498a. you may visit www.karvai.in to read more on dowry laws.
Generally action is taken on govt / semi govt employees in such cases ( Preferably when due to non availability of bail he being arrested has to remain in prison / police custody for a period of 48 hours or more). Pvt undertakings and public / pvt companies take the cases u/s 498a as personal matter unless the employee is finally held guilty and convicted of that offence.
Normally the company would consider it as his personal matter till the outcome of this case. Please check Sanjay Kalra and Associates on the internet to know more about our law firm and the kind of legal services rendering for our clients from all over the World. .
