Legal Question in Credit and Debt Law in Indiana

Am I responsible for my husband's credit card debt?

My husband and I are getting divorced. Prior to this, we were trying to build up his credit, and he opened his own credit card account. After opening the account, he requested a card in my name to use. I never used this card. Now we are divorcing, and he agrees to pay this debt; however, the credit card company will not take my name off the account stating he does not meet the criteria. None of my information was collected to open this account. I need some advice, please.

Re: Am I responsible for my husband's credit card debt?

It sounds like your credit history was used to procure your husband's credit card. And your name probably appears on the application. And the card company may imagine that your signature appears there, too. So ask the credit card company for copies of the application which shows you agree to be responsible. Make your request in writing, by certified mail, to the address listed on the credit card monthly billing statement for such inquires. If you did sign the application, then you will be fully liable, and your only remedy will be what can be paid by the ex-husband. If it turns out your signature was forged by someone, then report that to the card company and cooperate fully in their investigation.
