lawyers misuse of power
Good evening! I am representing my son, who is serving overseas, with my POA in a legal matter. I am trying to fulfill a court order to get insurance for a child that he fathered, however I am getting no cooperation from either the mother or her attorney. There are steps that have to be taken before the child is even considered eligible by the insurance companies. These steps are protocol for the US Gov. Question: Does her attorney have the power or authority to demand that I make no attempt to contact the mother by mail with a certified letter that will have instructions as to how we can get this whole mess resolved?

You didn't state if this was a divorce case or not? If not, has paternity been established? You may need to file a motion with the court to review support/visitation. Then you will be able to present your information to the court.

If you are not a licensed attorney, there is no prohibition regarding you having direct contact with the mother. The attorney can demand all he or she wants. As a courtesy, you may wish to copy the attorney on any correspondence that you do send.
