Legal Question in Civil Litigation in Indiana

I am a Licensed Clinical Social Worker in Indianapolis. About a year ago I had a disagreement with a team member on the decisions regarding a case. The team member did not like my response to her and began to accuse me of fraudulent billing and led people to believe we had a difficult working relationship historically in the social service field (which is not true). At the time I chose not to challenge her allegations and thought that she was just angry, she removed me from the case, despite the team defending me and calling meeting to mediate and resolve this (all of which she ignored). I decided at the time to just walk away and not defend myself because I believed she was just angry and the situation was over.

Now about a year later, a fellow contractor has reported that the previous team member has pulled him aside stating she is going to turn me in for fraudulent billing and that I have been reporting that I have been providing services to someone who states they don't know me. She went on to tell him about the bad working relationship and supposed power struggles. The contractor had no case with her, she sought him out and he feels that she has a vendetta against me.

I work for myself and recently became licensed. These allegations not only could cause serious harm to my career I am worried that she has already cost me referrals by these allegations. What legal recourse do I have? My supervisor attempted to reach her via telephone and she did not return the call. My supervisor is attempting to reach the team members supervisor now. I walked away a year ago, I don't want to do that again. I want to know what legal rights I have to make this woman stop these slanderous and malicious allegations that I have evidence did not happen.

Your recourse is to hire an attorney and threaten a lawsuit for her libelous statements. You may have to follow through with a lawsuit. Talk to an attorney who has done or does slander/libel cases. You'd probably be best to get a lawyer in your particular area.

I suggest that you contact a lawyer locally or online. He or she can send what is known as a cease and desit letter requesting her to stop spreading these things about you. If she fails to do so,you may have a slander case as well as a contractual interference case.
