Legal Question in Personal Injury in Kentucky

What should I do?

I was involved in an auto accident while making a delivery for work. The accident was not my fault. My employer gave me a name of an attorney friend of his and I retained him. It is now 26 months later and today i received a call from the lawyer with a settlement offer of $6,000 which was to include money for lawyer, medical bills ($12,000) or more...The insurance company adjuster states that all injuries are soft tissue - - What about lost wages, pain and suffering and loss of affection how are those supposed to be included in the sorry offer of $6,000. Do we make them a counter offer of what we think it is worth (how do we come up with a legitimate fair number?) or should we retain a new lawyer who has more experience with personal injury cases?

While 26 months seems kind of long to wait for a first offer, soft tissue injuries are notoriously high risk trial matters. Assuming fault is clear and the medical bills and treatment were reasonable and necessary, $6,000.00 is a very low offer. The adjustor probably has at least $10,000.00, maybe more to offer based upon my experience. If you don't think that's enough, i'd probably go ahead and discuss with your attorney regarding filing suit and litigating the matter. As far as your attorney and what you should do, I won't comment on another attorney's performance, nor will I advise you whether you should terminate the relationship. You have a contract and your rights should be spelled out therein. Good luck.
