I have custody of my cousin son, I just found the father. Its been six years since the last time he seen his soon. I am petitioning the courts for custody of the child. The father dont want anything to do with the child, but it seems like the defendant is draging this court case out so he doesnt have to pay child support. He says he is not the father, but in the state of maryland when the parent sign the birth certificate it is legal and binding. I filed in july of 2010, will i get a court any time soon.

You must properly serve the father and all other interested parties (including the mother, whom you didn't mention) with your petition and they have to answer the complaint within 30 days if they are MD residents, 60 if they aren't. If they don't answer you must file for a default and request an ex parte hearing. If he thinks he isn't the father he can request a dna test which can take some time. These are not simple cases and from the tenor of your question it may be wise to seek the assistance of an experienced family attorney.
