Legal Question in Family Law in Maryland

Can my mother take my son's father and I for child support if I'm required to pay her rent, as a way for providing a home for him, though I haven't signed any lease. And can he get arrested for trespassing on her property if he isn't welcomed for coming to see his son?

A party with custody can obtain child support from those legally obligated to support their child. Unless your mother has custody, she cannot get child support.

A property owner can choose who is welcome to come onto her property, and those who enter upon the property without permission may be guilty of trespassing.

If your mother has your son and if you and/or the father oppose this, consult a competent domestic relations attorney quickly to address custody issues. It is very difficult for a non-parent to win a custody case, but if the non-parent has the physical care of the child, her chances for obtaining custody improve.
