moving out of state
If I remarry and my new husband lives in VA. Can I move out of state? I live in MD currently. I have full physical custody and joint legal custody.

Yes, you can move. I would recommend registering the order in your new state of residence and advising your ex-husband of the move.

Check your custody order. You may be required to provide 45 days notice to the non-custodial parent regarding your plans to move out of state.

You can move. Notice will need to be provided to your ex-spouse. He may bring action to modify custody as the contemplated move would be a material change in circumstance. Your custody order may provide flexibility. Also, you may want to pursue having jursidiction transferred but your ex-spouse may contest this action.
