Legal Question in Workers Comp in Maryland
injured knee after slip and fall at work
I slipped and fell from water in front of the elevator of my unit at the hospital where I work. I've been under worker's comp since July 16th. It was only last Saturday that I got an MRI done on my right knee. I felt I needed it because the pain was still sharp on that knee. The result show bony bruise or microtrabecular fractures w/ other knee bones involvement. I would like to know if I can get a settlement at the end and if you can tell me a ballpark figure of that check? I have an appt with ortho next week. Thank you so much for your time.

Re: injured knee after slip and fall at work
Your settlement will be almost entirely dependent upon the permanent disability rating that your treating physician gives you once he determines that you have made the best recovery and further treatment is unwarranted. If the insurance company believes that rating is excessive, they will require you to submit to an examination by an physician of their choice. This "independent" doctor will usually give you a more conservative rating. Then you can either try and reach a settlement or put the matter before a workers' comp commissioner for decision.

Settlement would occur after a medical determination. Once proper maturation, you can file for a hearing and/or approval on the matter or settlement.
