credit card contract
How do you overcome the principle of presumption;where the court presumes that a consumer saw a contract and signed it ? Because most of the time we don`t and I didn`t. But I did resd the unsolicited offer and the ''agreement is nothing like the offer I agreed to.

This is difficult to overcome unless you can prove fraud, duress or unconscionable contract. There is also a federal statute that more or less says that every use of the card creates a contract.
