Legal Question in Discrimination Law in Michigan

Is this discrimination or harassment?

A business where my daughter works has been writing her up for not meeting her goals set. The problem is they are not writing up the other employees that are not meeting their goals. They have now put her on a three day suspension while no others have been. So is this drimination or is it harassment by management? Management went as far as writing her up for personal phone call, when I called the other day for a family emergency. What's this?

I am assuming that your daughter is not unionized. If she is unionized, then she has to file a union grievance. If she is not unionized, and she is being treated unfairly, there is no recourse under the law, unless the unfair treatment is the result of discrimination that would fall within civil rights protection. If the discrimination is due to race, religion, color, creed, national origin or sex, then she has some protection. There is no protection for being treated poorly. Discrimination is allowed unless it falls within one of the protected categories. Next time you hear someone badmouthing unions, recgonize that they do not know what they are talking about because one of the greatest benefits of unionzation, is protection from such unfair treatment.
