no lease signed. do i owe money?

I was living in a house for two months. we had a verbal agreement of $450 per month, which i paid on time both months i lived there. things went sour, and i moved out. there was no agreement, verbal or otherwise, stating that i had to give notice or live there for a certain amount of time. now i am being taken to small claims court. does she have a case against me?

Very likely the home owner will say that you rented on a month to month basis, that you were required to give notice before moving out, that you did not give enough notice, and you therefore owe another month's rent. Here is a copy of Minn. Stat. 504B.135, which would likely govern the situation. Since I don't know the amount for which you are being sued, I can't really comment more.

504B.135 Terminating tenancy at will.

(a) A tenancy at will may be terminated by either party by

giving notice in writing. The time of the notice must be at

least as long as the interval between the time rent is due or

three months, whichever is less.

(b) If a tenant neglects or refuses to pay rent due on a

tenancy at will, the landlord may terminate the tenancy by

giving the tenant 14 days notice to quit in writing.
