tenants drug selling

myfriend has a rental property with 3 tenants, they have alot of friends coming and going as they are young adults. recently a neighbor expressed concerns of suspicions of ''drug dealing'' she told my friends if her tenants are selling drugs she could lose her property. do you know the laws on this in minn.

Need to know city in which property located. Also what specific knowledge of criminal activity is in the hands of property owner.

I should also review the written lease.

Your friend is right to be concerned. Minn. Stat. 609.5317 authorizes the seizure of property if the landlord does not take affirmative legal action to evict a drug using tenant. She should review that statute and Minn. Stat. 504B.171. 609.5317 says, in part:

(c) Upon notice of a second occurrence on any residential rental property owned by the same

landlord in the same county and involving the same tenant, and within one year after notice of the

first occurrence, the property is subject to Previous MatchforfeitureNext Match under sections 609.531, 609.5311, 609.5313,

and 609.5315, unless an eviction action has been commenced as provided in paragraph (b) or the

right to bring an eviction action was assigned to the county attorney as provided in paragraph (b).

If the right has been assigned and not previously exercised, or if the county attorney requests an

assignment and the landlord makes an assignment, the county attorney may bring an eviction

action....
