Legal Question in Criminal Law in New Jersey
Originally charged with Lewdness but never arrested. I've been in and out of municipal court for approx 2 years now. 3 times they referred the case to superior and was sent back but recently they picked the case up and I was charged with 2C:24-4A & 2C:14-3B. There is no evidence whatsoever just "she said" accusation. What are the odds of the state winning a case like this with no evidence, especially when the victim is known for lying and making similiar accusations in the past? Her credibility is shot on many levels but I'm one of those who believe the system is screwed up sometimes, especially in my county. And yes I have seeked legal advice, acually 3 different attorney's but I just keep hearing it's a difficult case and the worst case scenerio's, nothing ever positive.

What a child says can be sufficient evidence for a conviction. If you will only hire an attorney who tells you your case is easily solved, you are looking for a lawyer who is willing to lie to you to get your money.

Without seeing all of the facts, no one can tell you the odds. Much also depends on your attorney. I agree with Mr. Moore, lewdness cases of any sort are tough and there is rarely an easy case. But look at it this way, what choice do you really have? Lawyers have to take hard cases and fight them. Some of us have won a lot of tough cases and yet, we have probably all lost a few "easy" cases. There is much that is out of your control. You need a lawyer that will fight his/her ass off for you as you may have no chance if you get anything less. If you have any follow up questions, just let me know at 732/773/2768.
